I bet he's a liberal judge who just hates the Bush administration. Judges shouldn't legislate from the bench!

Actually, she wasn't legislating from the bench, just upholding previous legislation such as the Separation of Powers doctrine, the Administrative Procedures Act, the First and Fourth Amendments to the United States Constitution, and the Foreign Intelligence Surveillance Act and Title III (of the Constitution) :)
Well, she is undeniably a very liberal judge who only cites other liberal judges in her decisions. The word I'm hearing is that the legal reasoning on this decision is fairly thin, and the Sixth Circuit is likely to overturn it. I imagine it would be difficult to not get an idealogical decision from either side, so we should probably expect this to end up at the Supreme Court, where it will get it's final idealogical decision (sad, indeed).
